Innovative SAT/ACT Programs
This agreement sets forth the terms of our engagement and the nature of our services to be provided as well as your responsibilities in connection with such services.
Throughout the agreement, “academic tutoring” will be referring to all tutoring besides SAT, ACT or SAT Subject Test tutoring. “SAT tutoring” will be referring to SAT, ACT and SAT Subject Test tutoring. Tier One Tutors, Inc. will be referred to as “Tier One.”
Tier One is a provider of in-home, one-on-one academic, SAT and test prep tutoring. You wish to engage us to provide a tutor at your home during prescribed times mutually agreed upon in advance to perform said tutoring.
Fees and expenses are billed before tutoring is actually rendered. Absolutely no tutoring may be had unless the hours have been pre-paid on credit card or check through the administrators. Under no circumstances are tutors to be paid for services directly, all monies must be paid to the Tier One administrators. Tier One reserves the absolute right, without limitation or penalty, to stop all work in the event there are disputes and/or delinquent fees due us.
In the event client hires directly a tutor currently under the employment of Tier One, or a tutor that is contracting with Tier One or who has been employed by Tier One or that has contracted with Tier One within the previous 12 months before said hiring, client agrees to pay the sum of $2,000 to Tier One as liquidated damages, payable immediately to compensate for lost income and reimburse for the cost of training, interviewing, advertising, etc.
Client also agrees to sign the tutor’s timesheet to ensure that there are no disagreements about how many hours have been used. If client does not agree with the hours that the tutor has logged, then they should not sign the sheet. Once the sheet is signed by the client, this will be seen as a contract agreement whereby client agrees that said hours have been used. Client also agrees to allow their child who is 13 years of age or older to sign timesheet on their behalf. Child’s signature on said timesheet will constitute an agreement to that timesheet by parents and those hours will be considered completed in full.
Tier One offers an absolute, no-questions asked money back guarantee for the first hour of tutoring. If client is not satisfied after the first hour, Tier One will reimburse, at no cost, the fees paid by client. Nevertheless, client must prepay Tier One for tutoring before the first hour of tutoring is rendered. Tier One cannot and does not guarantee results of raised grades, test scores or any other academic or achievement indicators. Tier One does not offer refunds or money back for dissatisfaction with the tutoring, the tutor, grades, test scores, unused hours or for any other reason. Purchase of tutoring hours are therefore a purchase of those hours in and of themselves, not a purchase of a service that will create an improvement. If Tier One provides the tutoring hours that client pays for, that will be seen as a completion of the terms of contract on behalf of Tier One.
After the first hour of tutoring is rendered, Tier One does not offer refunds for unused SAT, ACT or Subject Test tutoring hours. SAT tutoring hours are not transferable including to siblings, relatives, friends, etc. For academic tutoring, once hours are purchased, they are allowed to be used only for the student they were purchased for. They are not transferrable. They are allowed to be used for a similar subject and same price per hour tutoring but not for tutoring that is more expensive per hour. Tier One does not promise that we will have a tutor available for a subject that was not part of the initial agreement. Client can trade academic tutoring hours for SAT tutoring at a 2:1 ratio (two academic hours for each one SAT tutoring hour) but cannot trade SAT tutoring hours for academic tutoring. Furthermore, all tutoring hours, whether academic or SAT hours, expire after 12 months from date of purchase, at that time no tutoring will be rendered and no refunds will be given for any reason.
Client must give at least 12 hours notice before a session if said session must be cancelled or postponed. Tier One allows one cancellation and one postponement without charge. However, after the first cancellation and first postponement, if 12 hours notice is not given, client will be billed for the amount of time the session was scheduled for. Client also agrees to have an adult home during all tutoring sessions.
All materials provided by Tier One may not be re-distributed, re-sold, copied, given away to friends or family or otherwise re-used.
This agreement is governed by California law and any dispute shall be resolved in Van Nuys, CA regardless of where the tutoring took place. This agreement supersedes any previous agreement and constitutes the entire agreement between the parties and supersedes any other oral or written agreement or offer. Furthermore, signing the service agreement, which shows your agreeing to the terms above, applies to all previous sign ups with Tier One as well as all future sign ups regardless of whether the services agreement was signed independently for those sign ups.
The foregoing is in accordance with Tier One’s understanding and we hereby agree to its terms and conditions.
